Fillmore County has several Policies and Permits you must abide by if you want to do work on or adjacent to a County Roadway. There are three different permits listed for your convenience. You may print them out and send them to our office or hand deliver them. There are two parts to each permit that must be submitted, the Permit Application and the Map showing the exact location of work being done.

AMENDED CULVERT AND ACCESS DRIVEAY POLICY - 12/13/2016
All access driveways on the county highway road system, earth filled or otherwise, to be installed only after receiving permission from the Fillmore County Highway Superintendent’s office. (All permits to be signed by the landowner.) Location of said drive shall be inspected by the Fillmore County Highway Superintendent’s Office to determine the need for a culvert in said drive. Said culvert shall be a minimum of 18” in diameter. Fillmore County Highway Superintendent’s Office has authority to approve all drives up to 40 foot in length. An application for a drive longer than 40 foot in length shall be presented to the Fillmore County Board of Supervisors by said applicant and shall be approved by the Fillmore County Board of Supervisors. Cost, installation and maintenance of all drives to be the responsibility of the landowner.
All access driveways on the county highway road system, earth filled or otherwise which applicant wishes to extend will be inspected by the Fillmore County Highway Superintendent’s Office. You may extend existing culvert size if such culvert is in working condition and there are no signs that this culvert is too small for proper drainage. If there is a need for a new culvert to be placed at this location said culvert shall be an 18” minimum culvert. Said drive will be no longer than 40 foot in length unless approved by the board.
The Fillmore County Highway Department shall provide one 24 foot driveway tube for rural occupied residences. Said drive to be the main drive into said residence. The need for and diameter of such tube to be determined by the County Highway Superintendent’s Office.
Fillmore County, at the discretion of the County Highway Superintendent’s Office, shall provide and install one driveway tube for all rural cemeteries. The need for and diameter of such tube to be determined by the Fillmore County Highway Superintendent’s Office.
All previous resolutions, motions and policies in relation to residential and field driveways are hereby rescinded.

The State of Nebraska has laws that make it illegal to dump anything in a County Road Ditch.
The State of Nebraska also has laws regarding mowing roadway ditches and keeping trees trimmed so they do not become a public nuisance. Please click on the following laws and review them.
